Purchase Conditions

These general contracting conditions are applicable to all commercial transactions carried out in our virtual store www.joyeriamarcos.com, hereinafter referred to as the Seller. For more information about the Seller and our Privacy Policy please consult the Legal Notice located at the bottom of each page of this store.

Please read these Purchase Conditions and our Privacy Policy carefully before placing an order. If you do not agree with all of the Purchase Conditions or with the Privacy Policy, you should not place an order.


The Seller is a business unit belonging to Joyería Aurelio Marcos S.L., holder of CIF/NIF B-92375435, domiciled at C/ Marqués de Larios nº2, C.P. 29005, Malaga. Any communication may be sent by mail to the registered address, made by telephone at 657 66 22 01 or by email sent to online@joyeriamarcos.com.

1. Activity

The Seller is devoted to the sale of watches and jewellery.

2. Content and information supplied on the website

The Seller reserves the right to modify the commercial offer presented on the website (modifications of products, prices, promotions and other commercial conditions and of service) at any time. The Seller shall make all reasonable efforts to offer the information contained on the website with accuracy and without typographical errors. In the event that this type of error should occur at any time, completely unconnected to the Seller’s intentions, it shall be corrected immediately. Should there be a typographical error in the any of the prices shown and a client makes a decision to buy based on said error, the Seller shall inform the client of said error and the client shall be entitled to cancel the purchase without any cost for the latter.

The contents of the website may, on occasions, show provisional information regarding some products. In the event the information provided does not correspond to the characteristics of the client’s product, the latter shall be entitled to cancel his/her purchase at no extra cost.

The Seller is not directly or indirectly responsible for any information, content, manifestation and expression contained by the products sold by the Seller. Said liability corresponds at all times to the manufacturers or distributors of said products. The client understands that the Seller is merely an intermediary between the former and said manufacturer or distributor.

In order to make a purchase, the user many place an order in different ways:

  • By telephone, calling the customer service number 657 66 22 01 during business hours (mornings 10:00-14:00 and afternoons 16:30-20:00 from Monday to Friday and on Saturdays 10:00-14:00)

4. Forms of payment

Payment by Credit Card: We accept the following credit cards: Visa, Mastercard….,

The charge on the credit card shall be deferred until the shipment is ready. This way, only the goods shipped are charged, and only when the shipment is ready. In the event the POS should report that the card has been rejected, the order shall be immediately cancelled, and the client shall be informed online of the cancellation.

Payment by credit card is completely secure, since an encrypted HTTS connection with a 256 bit SSL certificate is used.

For payment with credit cards issued outside Spain, the issuer bank must be enabled to use the Protocol for Secure Electronic Transactions (SET). Payments with credit cards that do not comply with this requirement shall not be accepted.

For security reasons, Joyería Aurelio Marcos reserves the right to not accept certain operations made with credit cars. In the event an order is cancelled after it has been charged, the amount charged shall be refunded at that moment to the original credit card debited.

Payment by Transfer:

We accept payment of an order by bank transfer or deposit of the price of the order in our bank account, which will not entail any additional charge for the client. The cost of a bank transfer shall be on account of the person ordering payment. In the box for concept, you must indicate the order number and the name of the person placing the order. Please bear in mind that the shipment shall be dispatched once the funds have been credited to our account. This circumstance will usually delay shipment a day or two.

If the transfer is not made within ten days, the order will be cancelled.

5. Form, cost and times of shipping

Clients may choose the form of shipping they prefer from the ones available for their area of delivery, bearing in mind that the delivery time, the quality of the service, the place of delivery and the cost will differ depending on the form of transport.

The Seller ships orders to its Clients through different well-known national and international courier services. The date of delivery at the client’s domicile depends on the availability of the product ordered and the area of delivery. The general delivery times for information purposes are available in the section of our website «Shipping Fees». Before confirming an order the client is informed of the shipping fees and times applicable to the specific order, said information being merely illustrative. However, the fees and times may vary depending on the specific circumstances of each order. In particular:

Transport times may be altered by extraordinary incidents on the part of the carrier and due to difficulties in delivery of the goods. Shipping fees that appear on the website when the order is placed are illustrative and are calculated on the basis of an average statistical weight of 500 grs. The Seller reserves the right to later the shipping fees when the weight of the product ordered is 10% higher/lower than the average weight mentioned. In the event the fees are varied, the Seller shall inform the client of the variation by email, and the client may choose to cancel the order without having to pay any extra cost.

Notwithstanding the foregoing, shipping in the Peninsula and to the Balearic Islands will be free of cost.

Shipping fees include transport, insurance and customs clearance at point of origin. For deliveries in countries that do not belong to the European Union, the fees do not include customs expenses at destination or other duties; they will be paid in cash by the addressee in order to receive the goods, irrespective if they are collected or not.

Joyeria Aurelio Marcos shall not be liable for delays in customs clearance or if local authorities decide to confiscate any element contained in a shipment.

Depending on the type of product and the destination selected, there may be limitations or special conditions for shipping. 

6. Buyer’s rights and policy of returns

The Seller does not guarantee to its customers the availability or delivery time of the products offered on its website. The catalogue shown is merely indicative as the manufacturers or distributors do not communicate stocks in advance or guarantee delivery times. This situation prevents the Seller from being able to accurately inform its customers about the availability of the products as well as to guarantee a specific delivery time which, in any case, will depend on the time taken by the manufacturer or distributor to supply the product.

The Seller guarantees its customers the possibility of cancelling their order at any time and free of charge, provided that the cancellation is communicated before the order has been made available to the carrier for shipment. Deliveries are made within 24 hours on the peninsula and are insured.

In case of return, the products can be exchanged for other products or you can receive the money back. This return can be made either in person at the shop or from home. The customer will have a period of fifteen days from receipt of the order to terminate the contract and return the purchased product. The client will communicate to the Seller within the stipulated period and by any means admitted in law, his wish to exercise the right to terminate the contract. The returned order must be delivered together with the delivery note and, if applicable, the invoice issued to the Seller, and the Client will be responsible for the return costs and any expenses generated in the purchase.

The client will be able to return any article that he/she has purchased from The Seller as long as the products have not been opened or used and retain their original seal or packaging. In these cases, The Seller will return the purchase money through the same means that The Client used for the purchase.

If a product other than the one ordered by the client is delivered due to an error on the part of the Seller, this will be withdrawn and the correct product will be delivered without any additional charge to the buyer.

7. Right of withdrawal

You may exercise the right of withdrawal within the statutory period of 14 days from the day after the date of a service contract or the day of receipt of a product.

8. Clients’ obligations

The Seller’s Clients undertake to provide at all times true information regarding the data requested in the user registration forms or order forms, and to keep said information updated at all times.

Clients undertake to accept all of the provisions and conditions contained in these General Contracting Conditions, with the understanding that they contain the intention to provide the best possible service for the type of activity carried out by the Seller.

Likewise, Clients undertake to maintain with utmost diligence their personal password to our website in a confidential manner.

Clients undertake to enable delivery of the order placed by providing an address at which the order can be delivered within the normal timetable for the delivery of goods (from Monday to Friday, from 10:00 to 1:30 PM and from 4:00 to 6:00 PM). In case of non-compliance by the client of this obligation, the Seller shall not be liable for any delays or impossibility of delivery of the order placed by the client.

9. Taxes

Residents of the European Union:

The prices of products that are on sale in our e-commerce stores include the Added Value Tax (V.A.T.).
Purchases that are made by VAT taxpayers (companies, entities, organizations…) residents of the European Union and holders of intra-community tax number shall be exempt from the VAT, subject to sending said document by fax to +34 952 60 11 64.

Residents in non EU-member countries:

Purchases made by natural persons or legal entities residents of non EU-member countries are exempt from VAT payment. Orders shall not be sent to Post Office boxes.

For this system of delivery, and given their tax system, Ceuta and Melilla are considered as non EU-member countries.

You are reminded that the prices indicated for shipping fees do not include import duties, which must be paid in cash at the place of destination by the receiver of the goods.

The purchase system is subject to legislation in force in Spain. In consequence, the sale operations shall be deemed to take place at the registered address of Joyería Aurelio Marcos.

10. Governing law and competent jurisdiction

Purchases made from the Seller are subject to the legislation of Spain. In the event of any conflict or discrepancy, the parties submit, at their choice, to the Courts and Tribunals of the User’s domicile for the resolution of conflicts and renouncing any other forum.

11. Product guarantee

All of the products offered by the Seller have a three-year guarantee in the territory of the European Union. In the rest of the world, the conditions and time of the guarantee shall be subject to the conditions of the manufacturer of the brand of watches and to the legislation of each country.

12. Sale restrictions

Since Joyeria Aurelio Marcos is a distributor of original brands, if any of these brands should limit sales in certain countries, products purchased shall not be delivered in said countries.
